Sumter Man Arrested, Charged with Sexual Assault and Burglary After Terrorizing Elderly Woman

sexual assaultA young man has been arrested and charged with sexual assault and burglary after the violent attack on an elderly woman over the weekend.

On Tuesday, October 14th, Bryan Ontrell Rolle, 23, was arrested and charged with first-degree criminal sexual conduct, first degree burglary, and kidnapping.

According to police reports, about 11 PM on Saturday, October 11th, a 76-year-old woman was taking the trash out by the back of her home when Rolle approached her and forced his way into the house. He allegedly took the woman to the bedroom, where he physically and sexually assaulted her.

The victim was able to give a description of her attacker to the police, and she later picked him out of a lineup. About 12:30 Pm on Tuesday, Rolle was located and arrested outside of a home in Sumter, although it was unclear if Rolle was staying at the house in which he was found.

At the time the sexual assault and burglary was committed, Rolle was out on bond for a previous burglary charge dating back to June. Rolle also has previous arrests for assault and battery, and contempt of court.

“We have an individual who would break into the home of a frail, elderly female, sexually assault her and burglarize her,” said Police Chief Russell Roark. . “This is a terrible thing for her to live through.”

“These are very unfortunate circumstances,” Roark continued. “A horrible thing for a lady to live through, but it did come with some positive news and that is that we did make an arrest.”

Police believe there was some acquaintance between Rolle and the victim,  but investigators are not clear on the relationship. Meanwhile, Rolle is still in the Sumter-Lee Regional Detention Center awaiting a bond hearing.

“People do some terrible things to each other, especially when it involves the elderly who can not defend themselves,” said Roark. “When you have a gentleman break into their home, sexually assault them, physically assault them, it’s only by the grace of God she was able to get away.”

Sexual Assault Charges in South Carolina

South Carolina law defines sexual assault in three degrees:

“(A)    A person is guilty of criminal sexual conduct with a minor in the first degree if:

(1)    the actor engages in sexual battery with a victim who is less than eleven years of age; or

(2)    the actor engages in sexual battery with a victim who is less than sixteen years of age and the actor has previously been convicted of, pled guilty or nolo contendere to, or adjudicated delinquent for an offense listed in Section 23-3-430(C) or has been ordered to be included in the sex offender registry pursuant to Section 23-3-430(D).

(B)    A person is guilty of criminal sexual conduct with a minor in the second degree if:

(1)    the actor engages in sexual battery with a victim who is fourteen years of age or less but who is at least eleven years of age; or

(2)    the actor engages in sexual battery with a victim who is at least fourteen years of age but who is less than sixteen years of age and the actor is in a position of familial, custodial, or official authority to coerce the victim to submit or is older than the victim. However, a person may not be convicted of a violation of the provisions of this item if he is eighteen years of age or less when he engages in consensual sexual conduct with another person who is at least fourteen years of age.
